Waste facility condition of entry and safety guidelines

By entering a Bundaberg Regional Council (Council) Facility, you agree to the following terms and conditions: 

General 

  • Entry to and use of the Facility (including use of equipment and internal roads) is at your sole risk and responsibility. 
  • Council makes no representations or warranties as to the suitability of the Facility for your purposes. 
  • Council reserves the right in its sole discretion to refuse you entry or remove you from the Facility for a breach of these conditions. 
  • Council reserves the right to inspect and refuse any item, material or load, (including vehicle loads) that is intended for disposal.
  • You must: 
  1. comply with all relevant and reasonable directions contained in any sign displayed at the facility by the facility’s owner or operator.
  2. deal with the waste in accordance with reasonable instructions given by the person in charge of the facility; and
  3. if asked by the facility’s owner or operator—give information to the owner or operator about the type and amount of waste being delivered.

Legal 

  • You agree and acknowledge that, to the maximum extent permitted by law, Council,  its employees, agents or contractors are not liable for any damage or loss whatsoever which is suffered by you (including direct, indirect, economic loss or consequential loss) or any personal injury or death or loss of, or damage to property sustained by you or caused by any acts or omission of Council or its employees, agents or contractors, or any other person present at the Facility howsoever such liability arises and whether arising in tort (including, without limitation, in negligence), for breach of contract (including without limitation under an indemnity), under statute, in equity or otherwise.
  • You indemnify Council against liability for or in respect of any claim, demand, action, suit or proceeding, cost, expense, loss, damage, injury or death or any person (including you) arising out of or in connection with your acts or omissions whilst at the Facility.

Fees 

  • Disposal fees or waste vouchers may apply when you dispose of general or green waste. 
  • You agree to make payment for use of the Facility in accordance with Council’s Waste Disposal Fees and Council may pursue avenues for recovery of any amounts owed by you relating to the use of the Facility. 
  • Council may impose administration charges as set out in Council’s Fees and Charges Schedule as amended from time to time. 
  • Council reserves the right to refuse you entry to the Facility where you or the vehicle you are using at the time has an outstanding debt to Council for fees relating to use of any Facility. 

Safety

  • Children and animals must remain in vehicles at all times. 
  • You must comply with all State and National Road rules, vehicle mass, dimension and load restraint requirements while attending the facility. 
  • Whilst at the Facility you are responsible for your own property. You must not leave your bags or possessions unattended at any time.
  • Smoking, vaping and consumption of alcohol at the Facility is strictly prohibited. 
  • Lighting of fires, unlawful entry, unauthorised disposal of waste (littering or illegal dumping) and scavenging is prohibited and will be reported. 
  • Threatening, violent, abusive or offensive behaviour towards any other person or property (including property at the Facility) will not be tolerated. This type of behaviour may result in offenders being asked to leave.
  • Ensure you are dressed for safety when visiting the Facility by wearing fully enclosed shoes. Long pants, protective glasses and protective gloves are recommended.
  • For heavy loads, bring a friend or family member to help you unload.
