Council's Health and Environmental Services section regulates premises in the region under the provisions of a variety of different pieces of Legislation. All premises are to be built and operated in accordance with legislative requirements. Legislation specific to the type of operation is listed below:
- Food Premises are regulated under the provisions of the Food Act 2006, Food Safety Standards and Australian Standard 4674
- Personal Appearances (Body Piercing, tattooing, hairdressers, beauty salons etc) are regulated under the provisions of the Public Health (Infection Control of Personal Appearance Services) Act 2003
- Environmentally Relevant Activities are regulated under the provisions of the Environmental Protection Act 1994
- Premises Storing Flammable and Combustible Liquids are regulated under the provisions of the Dangerous Goods and Safety Management Act 2001 and the Australian Standard 1940
- Flats and Units are regulated under the provisions of 'Council's Local Laws - Chapter 21'
- Caravan Parks are regulated under the provisions of 'Council's Local Laws - Chapter 37'
- Footpath Dining is regulated under Council's Footpath Dining Policy
- Trade Waste is regulated under Council's Trade Waste Policy
Council's Health and Environmental Services Department ensures local businesses comply with these regulations and are available to provide advice on how to meet legislative requirements.
Requirements
Prior to commencing any businesses detailed above, an application must be submitted to the Health and Environmental Services Department of the Council for approval BEFORE any construction, renovation or alteration of any premises is carried out or any trading begins.
Applications must be completed in full.
Some Licences can be transferred but others will require reapplication.
Food Premises
All applications are to include two copies of various plans drawn to scale.
- Site Plans - not less than 1:100 showing site location, waste storage, sanitary conveniences.
- Floor plan - not less than 1:50 containing details of all equipment, fixtures and fittings. Sinks should be included in detail as single, double and approximate depth. The floor plan should indicate the type of materials used.
- Sectional Elevation - not less than 1:50 and should indicate height of structures, benches, floor clearances, equipment and fixtures
- Mechanical exhaust ventilation plans - not less than 1:50 and must comply with Australian Standard 1668.2.
Food Hygiene Course
Each year Council's Health and Regulatory Services run the Basic Food Hygiene Course. The aim of the course is to provide participants with food hygiene skills and knowledge that satisfies the requirements of the FSANZ: Food Standard Code. It is recommended that all food handlers involved with a food business and community organisation who have not undertaken any training in food hygiene attend a course. Courses continue to be free of charge and are held throughout the region.

Flammable and Combustible Liquids Storage
Any premise that stores in excess of the minor storage quantities as stated in Australian Standard 1940 of Class 3 flammable or combustible liquids must apply for a licence. A number of exemptions are provided under the Act - mines and land of more than 5 ha used for farming (provided liquids are not stored for resale).
Applications must provide details of the maximum quantities of flammable and combustible liquids held/or likely to be held on site. A detailed site plan must also be included with the application.
Trade Waste
Premises that require a permit under the policy must submit plans on trade waste lines, details of any pre treatment devices installed, waste characteristics and estimated volumes of waste generation.
